This website is operated by Budget Fitz. The terms “we,” “us,” and “our” refer to Budget Fitz. By visiting our site and/or using our platform, you engage in our “Service” and agree to be bound by the following terms.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our services. By using our website, you confirm that you meet this requirement.

3. Account Registration

To access certain features, such as buying or selling products, you must create an account. You are responsible for all activity under your account and for keeping your credentials secure.

4. Orders and Cancellations

Orders require advance payment, with any remaining amount payable via Cash on Delivery. Cancellations are allowed within 1 hour of order placement; beyond that or once shipping begins, cancellations are not accepted. Refunds for valid cancellations or returns are processed within 15 working days. If an order is refused at delivery, only the balance (minus delivery charges) is refunded. Returns and exchanges are arranged via courier, with exchanges subject to availability. Please read the “Cancellation and Refund Policy” for more details.

5. Pricing and Payments

Prices are listed in INR and are inclusive of applicable taxes unless otherwise mentioned. Payments must be made at the time of purchase using accepted methods. Prices are subject to change without notice.

6. Shipping and Delivery

Orders are shipped within the estimated timeframes, which may vary. Delays caused by courier services or unforeseen factors are not under our control. For vendor-shipped products, sellers are responsible for timely delivery.

7. Intellectual Property

All content on this website (logos, graphics, text, images, etc.) is owned or licensed by Budget Fitz and protected by copyright and trademark laws.

8. User Conduct

Users agree not to use the platform for unlawful, fraudulent, or abusive purposes. Any misuse may result in termination of service or legal action.

9. Vendor/Seller Terms and Conditions

This section applies to users who register as Sellers via Seller Registration Page.

a) Vendor Registration

Vendors must provide accurate business and contact information during registration. Approval of a seller account is at the sole discretion of Budget Fitz.

b) Product Listings

Vendors are responsible for ensuring all listings are accurate, not misleading, and comply with applicable laws.

Prohibited products are not allowed and may result in account suspension.

c) Order Fulfillment

Sellers are responsible for packaging, shipping, and timely delivery of their orders.

Any delays or customer complaints will be reviewed by Budget Fitz.

d) Commission & Payment

Budget Fitz charges a fixed or percentage-based commission on each sale.

As a budget fitz seller, we prioritize fast payments. Prepaid Orders including Cash on Delivery (COD) orders, payment will be securely transferred to your bank account within 7 days of order delivery.

Budget Fitz reserves the right to hold payments in cases of dispute, fraud, or refund requests.

e) Returns, Refunds & Disputes

Vendors must honor the return/refund policies agreed upon during onboarding.

In the event of a dispute, Budget Fitz will mediate and has the final say in resolution.

f) Code of Conduct

Sellers must maintain professional behavior, respect customer privacy, and uphold the platform’s reputation.

Spamming, manipulation of reviews, or selling counterfeit goods is strictly prohibited.

g) Termination

We reserve the right to suspend or terminate any seller account for violation of terms, fraudulent activity, or poor performance.

10. Third-Party Links

Our website may include links to third-party websites. We are not responsible for their content or practices.

11. Limitation of Liability

Budget Fitz is not liable for any indirect or consequential loss arising out of your use of the website or products purchased or sold through it.

12. Indemnification

You agree to indemnify and hold Budget Fitz, its directors, employees, and affiliates harmless from any claims or demands made by any third party due to your breach of these Terms.

13. Changes to Terms

We may modify these Terms at any time. Continued use of our website after changes are made constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of India. Any disputes will be handled in the courts of Kolkata, West Bengal.
